Procedure to agree External Changes to Adonis Village Properties
2008 AGM Decision on External Change Procedure
At the 2008 AGM, a formal procedure was adopted to ensure a fair and transparent process for considering external change requests made by property owners. The rationale behind this decision is rooted in maintaining the integrity and aesthetics of Adonis Village (AV), while balancing the individual preferences of owners within a shared community.
Key considerations include:
1) Legal Framework: The General Agreement, which governs all property owners, is a legally binding contract. It provides specific guidelines on what changes can be made to the exterior of properties, ensuring consistency across the village.
2) Community Responsibility: As AV is a communal living environment, individual actions can impact others. Therefore, all owners must adhere to shared rules and standards to maintain order and avoid disrupting the harmony of the village.
3) Protecting Standards and Value: Adhering to established rules ensures that AV remains an orderly, well-maintained community. This not only protects the aesthetics of the village but also preserves property values.
4) Balancing Individual and Community Needs: While the Management Committee (MC) recognises and respects the wishes of individual owners, it is essential to balance those preferences with the interests of the entire community.
5) Key Evaluation Criteria: The MC evaluates external change requests based on the following:
a) Impact on Other Owners: Does the proposed change negatively affect the rights or enjoyment of neighbouring properties?
b) Consistency with Village Appearance: Does the change significantly deviate from the established look and feel of AV?
c) Potential Negative Consequences: Could the change have a wider, detrimental effect on the village or its facilities?
d) Legal Compliance: Is the proposed change in line with local regulations and the General Agreement?
This approach ensures a balanced and reasonable process for managing external changes while safeguarding the overall character and value of Adonis Village.
Procedure for Submitting an External Change Request (ECR)
1) Submission of Request: If an owner wishes to make any external changes to their property, they must submit an External Change Request (ECR) via email. The request should include a brief description of the proposed change, along with supporting documents such as images or plans. This email should be sent to both the Management Committee (MC) Chairman and the Property Manager.
2) MC Review and Website Publication: Once the ECR is submitted, the MC will review the request and assess its viability. Following the assessment, the MC will publish the request on the Adonis Village (AV) website. The published material will include the request, the MC’s decision (approval, approval with conditions, or rejection), and any relevant correspondence regarding the request.
3) Conditional Approval and Waiting Period: If the MC approves the ECR (with or without conditions), the decision will be subject to a 28-day waiting period. During this time, other property owners may raise objections.
4) Proceeding with the Change: If no objections are received within the 28-day period, the owner may proceed with the approved changes as outlined in the ECR.
5) Handling Objections: Should any objections be raised by owners during the 28-day period, the MC will carefully consider these concerns. If the objection is deemed reasonable and valid, the requested change will not be allowed to proceed.
6) Appeals Process: If an ECR is rejected by the MC or if an objection from another owner is upheld, the owner submitting the ECR may appeal the decision at the next Annual General Meeting (AGM). The AGM’s decision will be final.
7) Final AGM Decision: If the ECR is approved at the AGM, the owner can proceed with the external change immediately. Conversely, if the AGM upholds the rejection, the proposed change will not be permitted.
